cancellation of a registered trademark is being termed as ‘Rectification of Register’ under the provisions of The TradeMarks Act, 1999.

The following are the grounds for rectification:

• Non-use of the Registered Mark
• Contravention of failure to observe a condition entered on the register
• Entry made in the register without sufficient cause
• Entry wrongly remaining on the register or any error or defect in any entry in the register
